In cases against professionals for malpractice, a person must have retained an expert and have their opinion in hand before ever filing suit.  By statute, the defendant can ask the Court to dismiss or suspend the case until an expert is found by the plaintiff.  No expert, no case.  There are exceptions, but those cases where no one could argue that an expert was needed.  Typically, both sides have to pay their own expert witness fees, win or lose.
